Abstract

The world economic crisis is causing a crisis in democratic values on Northern societies dealing with the migratory phenomenon. States in Europe and the United States increasingly perceive migration as something to get rid off when it is no longer useful or profitable. The migrants’ human rights are sacrificed in the altar of national security, public order and economic recession. In the name of sovereignty, States apply migratory policies that go against the rights of migrant populations who are subjected to deportation and denied the basic right of being heard by an independent and impartial judge. This article’s main goal is to show that when a State fails to respect and guarantee human rights, people can resort to international protection systems that try to revert state decisions that were based on discriminatory migratory policies and go against human dignity.
